This Site (”Site” Refers to the websites www.wildlifegarden.com/sv, www.wildlifegarden.com/de, www.wildlifegarden.com, www.wildlifegarden.com/fr) is operated by Wildlife Garden (Wildlife Garden refers to Wildlife Garden AB which is 100% owned by Helena Nobel with the following company information: Company number: 556659-9451 Intra community VAT: SE556659945101 Registered office: Ängelholmsvägen 263, 26942 Båstad, Sweden)

1 General Terms

These Terms and Conditions (referred to as the “Terms and Conditions”) apply to all orders placed on the Sites by the User (The “User” refers to any natural person who is at least 18 years old and without business purpose) wishing to make a purchase on the Site.

The Terms and Conditions govern the Parties relationship (“Parties” collectively refers to the User and Wildlife Garden) and Wildlife Garden reserves the right to modify the Terms and Conditions at any time.  The Parties shall only be bound by the Terms and Conditions, which are online the day the order is placed.

Wildlife Garden strives to respect the possible Code of Conduct applicable in the User’s country of residence. Therefore, if one of the selling terms is missing, it would be deemed to be governed by the Customary Practices in force in the mail-order industry.

These Terms and Conditions aim to define the selling terms between Wildlife Garden and the User, from the point at which the order was placed until the after-sale services through payment and delivery. The Terms and Conditions are available in Swedish, English, German, French and Dutch, depending on which language the User has chosen.

Only the Products which are currently in stock are offered (The Terms & Conditions apply to products which are displayed and indicated as being sold and dispatched by Wildlife Garden). Should a product be temporarily out of stock and is still shown on the webpage as available, this is a mistake and you will immediately be informed. When a product is out of stock, a message will also be displayed alongside the order information on our website.

Many of the products in stock are handmade and, as such, unique. Although every care is taken to ensure they are as similar as possible, some variations may occur. The products are described and displayed as accurately as possible.  However, in the event of an error or omission, Wildlife Garden shall not be held liable. Products’ photographs are non-binding.

2 Prices

The prices of our products are displayed in SEK (Swedish Crowns) or € (Euros), including VAT (Value Added Tax) and, if any, price reductions offered the day the order was made.  The VAT is based on the current rate on the day the order was placed.  The price displayed on the article does not include delivery charges – these are indicated in the checkout before the order is confirmed.

If you reside outside of the European Customs Union you will be charged customs duties and/or taxes (including potential local taxes). In this case, Wildlife Garden will charge the User the order price exclusive of tax.  Please be aware that Wildlife Garden will not be able to find out what the taxes will amount to.  We therefore advise our Users to contact their Customs Office for further information.

The prices of individual Products quoted on the Site are only valid as long as they are online.

3 Placing an order

The User should place his/her order online, solely through the Site.

You do not need to register on our Site in order to place an order. Just click on the item you want to buy and it is placed in the shopping basket.

The user should fill out the appropriate delivery information asked for, paying extra attention to ensure that the mobile phone and e-mail address is correct.  By confirming the order (clicking Place Order) the user is accepting the Terms and Conditions and completing the sale contract between the Parties.

Confirmation of an order means that the User agrees with the prices, description and other information about the Products’ being sold.  Any objections regarding this will occur through the Users right to withdraw as well as the contractual and legal agreements below.

In order to correct issues with non-payment, incorrect delivery addresses or other issues relating to a User account, Wildlife Garden reserves the right to suspend the User’s order until the issue has been resolved.

In the event that a Product which has been confirmed and paid for is out of stock, sold-out or temporarily unavailable, Wildlife Garden will inform the User of its unavailability. In the case of it being sold-out, Wildlife Garden will remove the Product from the order and will issue a full refund to the User.  The rest of the order will however still be processed and delivered.

For any inquiry relating to an order’s tracking, the User shall contact Customer Services under the conditions laid down in the Preamble. After receiving the email confirming his/her order’s dispatch, the User can track it on using the information contained in the confirmation email.

Wildlife Garden shall acknowledge the User’s order by email sent to the email address that he/she provided before completing the order.

4 Payments

Wildlife Garden offers the following forms of payment for the User to complete their order online exclusively:

- by payment card: We accept payment by Mastercard, Visa and Maestro.  The order (the price of the dispatched items only) amount will be deducted from the User’s bank account only once the order has been forwarded.  In the case that an ordered item is temporarily unavailable or sold out the deduction of the payment card will only occur after the Product has been forwarded.

- with his/her PayPal account: By choosing to pay with PayPal, the User will be automatically redirected to their PayPal account. Once the PayPal payment has been confirmed, the User will be able to complete their order on the Site. The User’s PayPal account will be charged immediately after final confirmation of the order. A PayPal fee of EUR 4.69 applies.

- with invoice: Payment by invoice is only available if you live in Sweden. Customers wanting to pay using an invoice may be subject to a credit check, which Wildlife Garden reserves the right to take out – the user, therefore, needs to provide his/her Swedish social security number at the checkout. The order will be terminated if the invoice address does not match the address where the User lives or if the number is incorrect.  The invoice is sent to the User's registered billing address (if it is not in the parcel) and needs to be paid within 10 days of the issue date.  Failure to pay within 10 days will result in a statutory fee of 50 SEK plus an 8% interest rate fine.

The User may incur extra fees for using a foreign payment card.  Please contact your bank for information regarding exchange rates and/or exchange rate commissions which may be applicable.

By using the SSL system (Secure Socket Layer), Wildlife Garden guarantees confidentiality and security on payments that the User makes. Wildlife Garden will never ask the User to disclose their bank details via email—this is to help prevent fraud.

5 Delivery

The User can choose which country he/she wishes to have the order delivered to.  Information about delivery cost is shown in the checkout after the country and delivery method has been selected.

Wildlife Garden works in close partnership with DHL, UPS and the Swedish Post to deliver the User’s orders. Once the Order has been dispatched, an email is sent to the User with a parcel tracking number. In some cases when we ship to other countries the customer will receive a new tracking number when the goods arrive in their own country. Shortly before the parcels arrive at the delivery address, the User will receive a secondary notice via either text message or email. 

Deliveries should arrive within two to six days, depending on the courier; however, if your parcel has not arrived within this time, then please contact us so that we may resolve the problem as quickly as possible.  When your parcel arrives (or is collected from a service point), it is important that you have a valid identification and your parcel tracking number on hand.

Please be aware that items may be shipped separately (in separate parcels). In this case, you will receive separate tracking numbers for each parcel.  If you receive more than one confirmation message and tracking number, it may be that the shipment contains several packages.

6 Complaint

Wildlife Garden strives to maintain consistent product quality through meticulous quality control and testing. Despite this, we cannot assure you that defects never occur. If you receive a defective item, please contact us as soon as possible at customer services by email or phone so that we can resolve the problem.

7 Right of withdrawal, returns, refund

You are entitled by law to cancel your purchase within 14 days after you have received/collected your package. If you want to return your purchase, you must notify us within the cancellation period (14 days) at info@wildlifegarden.se or +46 431 76800, before returning the package. You do not need to give any reason for your cancelled purchase.

You are responsible for return shipping (unless the law in your country stipulates otherwise). The product must not be used and must be fully intact in its original packaging with all parts.

Please note that it does not count as exercising the right of withdrawal if you only refrain from collecting your delivery.

Wildlife Garden always aims to refund the buyer as soon as possible. A refund will be issued no later than 30 days after Wildlife Garden has received the returned goods and examined that they are in perfect condition. We try as far as possible to make the refund in the same way as the payment was made.

Returns within the EU:

Users within the European Union will have to return the order by his/her own means and at his/her own expense (unless otherwise stated).  The User can choose their preferred transport service.  However, if the User refuses to take the delivery of his/her order (e.g. if the parcel is damaged), the order will be sent back to Wildlife Garden by the same forwarder who delivered the goods. In this case, the User shall not bear the costs of returning the goods and shall be fully refunded.

Returns outside of the EU:

Users returning goods from outside of the EU will have to pay customs duties at the time of delivery (goods passing through territories in DDU (Delivery Duty Unpaid).  The User will need to go to the office of their chosen courier and fill in an export form. He/she will be asked to indicate the item’s country of origin, its price and the appropriate incoterm DDU: Delivery Duty Unpaid. The User shall bear the costs of returning the goods but not the export duties.

8 Unclaimed or Misaddressed Parcels

For parcels returned to Wildlife Garden due to non-collection or an incorrect delivery address, an administrative return fee of 15 euros per parcel will be charged. The original shipping cost will not be refunded. Refunds for the product value will only be issued once we receive the returned item.

9 Evidence, Preservation & Storage of Transactions

The confirmation of the order is the evidence of the order; the confirmation also makes the price of the items due.
The confirmation works as a signature and express acceptance of the transactions that are completed on the Site. If an imposter has used a bank card, the User should contact Wildlife Garden’s Customer Service as soon as he/she discovers this fraud, by calling +46 431 76800 (for English speakers) or +49 40 422 366 78 (for German speakers).

The computerised records of the order that is stored within Wildlife Garden and its partner's systems are, under reasonable conditions of security, considered as proof of communications, orders and payments that have occurred between the parties.

The archiving of forms, orders, and invoices is made in a format in order to comply with the requirements of Swedish law.

10 Liability

Wildlife Garden pledges to depict as precisely as possible every product sold on the Site. Wildlife Garden cannot, however, be held accountable when it fails to implement its responsibilities because of unanticipated circumstances outside of its reasonable control, such as force majeure or an event caused by a third party. Wildlife Garden can also not be held accountable for damages or problems caused by the use of the internet such as a computer virus, service interruptions etc.

Wildlife Garden can take no responsibility for marketing operations and activities that do not comply with provisions in the User’s country.

11 Intellectual Property

Content displayed on the Site, including audio, visual, logos, trademarks, models, and underlying technology, is patented, trademarked, and protected under copyright.  This means that their disclosure does not mean that Wildlife Garden authorises a right to use any of the said trademarks or distinctive copyrighted features.  Thus, utilising them would be a forgery.  It is therefore prohibited to share, reproduce, copy, post, transfer, download or distribute documents from the Site.

The only authorised exception to the above is for strictly personal use in the following way: The User may download a copy of documents from the Site for non-commercial, personal use.  The User may not change any of the information contained within the document and must always keep the branded notices and copyrights integral. Failure to comply with these guidelines through modification to or manipulation of these documents breaches the Intellectual Property rights of Wildlife Garden.

12 Personal Data

To competently perform its responsibilities, Wildlife Garden needs to obtain certain personal information from the User, such as their home and delivery address, contact telephone numbers, first and surname, and email address. The email address is needed so the User can receive a confirmation email regarding their order. Wildlife Garden is, by law, obliged to ensure that the personal data collected is accurate and up to date. The User, therefore, has the right to access, remise, and delete his/her data.

The Wildlife Garden site uses cookies to improve the user experience. By accessing the Site, the User accepts the use of cookies.

The Site uses session cookies. The cookie is terminated when the User closes their browser. A new cookie will be created if the User opens a new browser. Cookies enable us to provide more personalised and comfortable navigation. We do not use cookies to register information such as your name, address, or bank account information. The Site saves other information in the cookie as well, such as random data used to create an anonymous tracking statistic in our Webshop.

13 Law & Jurisdiction

Wildlife Garden follows the Swedish National Board for Consumer Disputes (ARN) recommendations and as such any disputes involving or relating to the Terms and Conditions will be treated in accordance with Swedish law.  This does not deny European consumers of their national statutory rights.
